ELECTION
  1. GENERAL PROVISION


    1. The elections for the posts bearers and the Members of the Executive Council of the Association shall normally be held annually not later than the second week of October of each year in a manner as may be prescribed.

    2. Provided that where it is not possible to held the elections during the period prescribed for the purpose, the reasons and position shall be explained in a meeting of the General Body convened during the last weeks of September of the same year. The general body may fix the date for the said election as it may deem fit.
    3. Only such ordinary members whose names are duly contained in the INAL LIST of the Electors shall be eligible to contest or to vote in the election
    4. The elections shall be pay secret ballot
    5. In case there is no nomination for any of the posts, the election for such post / shall be held in a manner to be prescribed.


  2. PREPARATION AND MAINTENANCE OF ELECTORAL ROLLS


    1. The Secretary shall prepare and maintain a list of all ordinary members of the Association as prescribed below. He / She shall issue a general notification giving the dates on which various actions as prescribed on these rules shall be taken.
    2. Issue of notice for enrolment.

    3. The Secretary shall before or on such date as may be fixed by the Executive Council notify that the electoral rolls of ordinary members are to be prepared and revised.

      Copies of such a notice shall be forwarded to all teachers.

      Any whole time teacher of he University who at the time of issuance of such a notice is not formally registered as an ordinary member or is not a member in good standing may apply for ordinary membership in a manner prescribed under clause (3 (a) iii).

    4. Preliminary Electoral Rolls.

    5. The Secretary shall prepare and publish the preliminary list mentioned within seven days after the date of issuance of the notice for enrolment.

      Copies of this list will be forwarded by the Secretary to all the members.

    6. Presentation of claims & objections.

    7. Persons claiming to have their name entered in the list or having any objectives to make against any entry there is shall make their claims and objections on writing to the Secretary within three days of the publication of he preliminary / list.

    8. Disposal of Claims & Objections.

    9. The executive council shall decide all claims and objections within several days following the day fixed for the receipt of the claim and objection.

    10. Application for review.
      1. A person aggrieved by the decision of the executive council may within three days after the last day fixed for disposal of claims may present an application in writing to the Secretary for review of the order.
      2. The Secretary shall place the application before a committee comprising of the President, Vice-President and joint Secretary who shall dispose off the application within seven day s of the last date fixed for submission of application.
      3. The decision of the committee shall be by majority vote.
      4. In case of equal vote the decision of the Presidetn shall be final and shall not be challenged in any court, internal or any authority whatsoever except for the general body.
    11. Electoral Rolls.
      1. The addition or dilation in the preliminary list shall be notified and the electoral rolls so prepared shall be notified by displaying a copy of the electoral on a notice board within 3 days of the day fixed for the decision on application for review
      2. Copies of the electoral rolls may be provided Secretary on request
    12. Eligibility for Vote / Contest Election.


    13. No person shall be qualified to vote or to be candidate for any office of Executive Council at any election held by the Association unless his / her name is included in the electoral rolls.

  3. ELECTION COMMITTEE TO BE APPOINTED BY EXECUTIVE COUNCIL.


    1. Election committee consisting of three persons shall be appointed by the executive council and approved by the General Body . One of them acting as Returning Officer.
    2. Decision of the Returning Officer / objection Election Committee can be challenged before the election committee within three days of the declaration.
    3. Decision of the Election Committee on application made against the final declaration of results shall be final and can not be challenged before any court or any other authority whatsoever except General body.


  4. NOMINATION


    1. An elector may nominate any other elector to be a candidate for election by proposal on a prescribed form obtainable form the Returning Officer, seconded by another elector. The person proposed shall sign the nomination form as a taken of his consent to stand for election
    2. The nomination form shall be forwarded to the Returning Officer so as to reach it not later than the day and time specified in the notification regarding election.
    3. The Returning Officer shall issue an acknowledgement receipt mentioning the date and time of receipt.
    4. Number of Nomination


    5. An elector shall be entitled to nominate as many persons for election as there are to be elected.

    6. Invalidation of Nominations


    7. If a proposer has signed the nomination papers of more than the number of member to be elected form a particular category, all nomination papers signed by him / her for that particular category shall be declared invalid.

  5. NOTIFICATION REGARDING ELECTION


  6. The returning officer shall issue a notice specifying the following;

    1. Number of members to be elected.
    2. The date & time by which nominations shall be received.
    3. The day for scrutiny of nominations.
    4. The day & time for the withdrawal of candidates.
    5. The date, hour & lace of the polling.


  7. SCRUTINY OF NOMINATION


    1. The Returning Officer on the day fixed for scrutiny shall scrutinize the nomination papers and shall declare which of the nominees have been validly nominated and qualified for election.
    2. The rejection of nomination paper shall not invalidate the nomination of a candidate under nay other valid nomination paper.
    3. The Returning Officer on the basis of scrutiny prepare and publish a list of validly nominated persons, i.e. candidates arranged in alphabetic order.


  8. WITHDRAWAL OF NOMINATION


    1. Any candidate, who is not declared elected up-opposed, may withdraw his candidature by notice in writing subscribed by him and delivered to the Returning Officer within the day and hour prescribed for withdrawal.
    2. No candidate who has withdrawn his candidature shall be allowed to cancel his withdrawal.
    3. If the number of candidates who have not withdrawn, is less than or equal to the number of vacancies, the Returning Officer shall declare all the candidates elected.
  9. CONTENTS OF BALLOT PAPER


  10. The ballot paper shall contain the names of all the candidates in alphabetic order of the official name.

  11. VOTING
    1. All voting shall be done in person.
    2. A voter shall vote putting either a tick mark or a cross mark in the space provided for the purpose in the ballot paper against.
    3. Each voter shall sign against his name in the voter’s list as a token of his having received the ballot paper.
    4. A vote shall be considered invalid.
      1. If it bears any identifying mark; or
      2. There is upon it any name, word or sign by which the person voting may be identified; or
      3. It has been lift blank by the voter; or
      4. The vote has not been caste in the manner prescribed under item 9 (b) above.
      5. The vote has not been caste in favour of more candidates than the number of persons to be elected; or
      6. There is any uncertainty about the identity of the candidate in whose favour the vote has been caste; or
      7. There is any defacement creating a doubt that there has been an attempt to alter or erase the mark on voting.
    5. After the expiry of the hours notified for polling, the ballot box shall be opened in the presence of the Returning Officer and such of the candidates of their authorizes agents as may be present.
    6. The Returning Officer shall examine each ballot paper and reject any which is invalid. The Returning Officer shall then proceed to vote count the number of valid ballot papers.


  12. COUNTING OF VOTES


    1. The total number of valid votes received by candidates shall be entered in a result sheet.
    2. In case of equality of valid votes between two or more than two candidates, the Returning Officer shall record the results on the basis of drawing of lots in the presence of the candidates or their authorized agents as may be present will be obtained by the Returning officer who should himself also sign the result sheet.


  13. DECLARATION PUBLICATION OF RESULTS


  14. Immediately after counting of votes, a list of elected persons shall eb prepared by the Returning Officer. Their names shall then be announced to the candidates or their authorized agents as may be present.

    A copy of the list so prepared shall be displayed out-side the office of the Returning Officer the same day.

  15. ELECTION PETITION


  16. The election of any candidates shall not be called in question except by means of an election petition which shall state clearly the mature of the objection and be presented to the Returning Officer within the time prescribed in the schedule. The petition shall be decided by the Election Committee as described in the election schedule by majority vote. The decision of the committee shall be final.

  17. BY-ELECTION


    1. In case no candidature in declared valid: fresh election will be held for these posts within a month of the declaration of the result of the election according to a similar schedule as the one prescribed for general elections.
    2. In case a seat falls vacant during the session either by the resignation of a ordinary member or by the decategorization of an ordinary member, specified for the next general elections, the posts will be filled in through by-election procedure in which a similar schedule will be followed as for general election except that the time for each stage will be reduced to half.
    3. In case a seat falls vacant within a period of less than six months prior to the specified for the forthcoming election the functions of seat shall be filled by a member of the executive council to be allocated by majority vote or the members of the executive council.
